Petition on relation of Saveland Park Holding Corporation (hereinafter referred to as the 'relator') for a writ of mandamus to command the defendant Donald G. Wieland, as building inspector of the village of Fox Point, to issue the relator a building permit to erect a residence building on its premises in said village. An alternative writ of mandamus was issued and the return of the defendant thereto based his refusal to issue the permit upon village zoning ordinance No. 129, which requires, as a condition precedent to the issuing of a building permit, the Building Board of the village to make a finding that the exterior architectural appeal and functional plan of the proposed structure will not be so at variance with those of other structures already constructed, or in the course of construction, as to cause a substantial depreciation in the property values of the neighborhood.
